(5) Loss of entitlement to benefits under Part A or B. If a person is no longer entitled to Part A or Part B benefits, CMS will inform the MARKETING authorization organization that the cancellation will take effect on the first day of the calendar month following the last month of eligibility for Part A or Part B benefits. (vi) Effective date of striking off. Unless further registration is chosen in accordance with § 422.54, the MA Organization shall strike a person off the roll if the MA Organization determines, on the basis of a written statement from the person or other evidence acceptable to CMS, that the person has moved permanently – (A) informing the person that the rewards are overdue; (v) CMS review of the proposed exmatriculation.

CMS reviews the information submitted by the MA organization and any information submitted by the recipient (which the MA organization must transmit to CMS) to determine whether the MA organization has met the requirements to request the disruptive behavior opt-out. The Organization may require that a participant who chooses to continue registration agree to receive the full range of basic services (excluding emergency and essential care) exclusively through the facilities designated by the Organization in the service area of the Plan.
